1. Acceptance of Terms

By accessing or using PerkyDash ("Service"), you agree to these Terms of Service.

If you do not agree, do not use the Service.

2. Description of Service

PerkyDash provides uptime monitoring, performance checks, SSL/domain expiry tracking, incident notifications, public status pages and related features.

The Service is currently in Beta. Features may change, be added or removed at any time.

3. Accounts & Authentication

You must:

  • Provide accurate account information
  • Use Google, GitHub or Magic Link for authentication
  • Maintain the confidentiality of your account
  • Be responsible for all actions performed through your account

4. Acceptable Use

You may not use PerkyDash to:

  • Monitor systems you do not own or have permission to access
  • Perform abusive scanning or excessive high-frequency probing
  • Interfere with or disrupt the Service
  • Circumvent rate limits or security features
  • Attempt unauthorized access to any system
  • Use the Service for unlawful or harmful purposes
  • Reverse-engineer or replicate core Service functionality

We may suspend or terminate accounts violating these rules.

5. Service Levels & Availability

The Service is provided "as is" during beta.

We do not guarantee:

  • Continuous, uninterrupted availability
  • Error-free operation
  • Accuracy or completeness of monitoring results
  • Timely delivery of notifications
  • Compatibility with all infrastructures or configurations

6. Monitoring Disclaimer (Critical)

PerkyDash performs automated uptime checks, performance measurements and incident notifications on endpoints you choose to monitor.

You explicitly acknowledge and agree that:

  1. PerkyDash does not guarantee that monitoring checks will run without interruption, delay, data loss or errors.
  2. PerkyDash does not guarantee that incident notifications (email, webhook, integrations, or any other form of alert) will be delivered, received or acted upon in a timely manner.
  3. Monitoring results may be delayed, incomplete or unavailable due to factors including (but not limited to):
    • network issues
    • DNS propagation
    • infrastructure outages
    • hosting disruptions
    • rate limiting
    • misconfiguration
    • third-party provider issues (OVH, Brevo, Stripe, Google, GitHub)
  4. You remain solely responsible for the uptime, security, maintenance, configuration and operation of your own servers, APIs, websites and infrastructure.
  5. PerkyDash is not responsible or liable for:
    • downtime of your servers or APIs
    • financial loss, revenue loss, business interruption
    • security breaches or data loss
    • consequences of missing, delayed or failed notifications
    • false positives or false negatives in monitoring
    • misconfigured checks or user errors
    • outages caused by third-party dependencies
  6. Monitoring and notifications are provided on a best-effort basis only. They do not replace adequate DevOps, observability or security practices on your side.

Strong additional disclaimer: PerkyDash must not be relied upon as your sole source of alerts or operational monitoring. It is your responsibility to maintain redundant monitoring and alerting systems.

7. Pricing & Plans

PerkyDash currently offers three plans:

  • Trial (Free) → 30-day log retention
  • Pro → 30-day retention
  • Agency → 6-month retention

Paid plans are processed via Stripe. Prices may change with notice.

8. Cancellation & Termination

8.1. User Cancellation

You may cancel your plan at any time through your dashboard.

Upon cancellation:

  • Plan changes apply immediately or at period end (depending on billing)
  • Monitoring data will follow the retention rules above
  • You may delete your account entirely at any time

8.2. Suspension or Termination

We may suspend or terminate accounts for:

  • Abuse or prohibited use
  • Security risks
  • Non-payment
  • Violation of these Terms
  • Actions that harm the stability or integrity of the Service

9. Payment & Billing

Payments are handled by Stripe. We do not store credit card numbers.

You authorize Stripe to charge recurring payments based on your subscription. Failed payments may cause suspension or termination.

10. Data Retention

Monitoring logs and historical data are automatically deleted according to your plan:

  • Trial / Pro → 30 days
  • Agency → 6 months

After deletion, data cannot be restored.

11. Intellectual Property

All content, software, design, trademarks and technology of PerkyDash remain our exclusive property. You may not copy, modify, distribute or republish any part of the Service without written permission.

12. Third-Party Services

PerkyDash relies on third parties including:

  • OVH (hosting)
  • Stripe (billing)
  • Google (authentication + analytics)
  • GitHub (authentication)
  • Brevo (email delivery)

We are not responsible for issues caused by these providers.

13. Limitation of Liability

To the fullest extent permitted by law:

  • PerkyDash is provided "as is" and "as available."
  • We disclaim all warranties, express or implied.
  • We are not liable for any direct, indirect, incidental, consequential, special or exemplary damages arising from use or inability to use the Service.

This includes (but is not limited to):

  • downtime of your servers
  • lost revenue, profit or business opportunities
  • missed alerts
  • damage to reputation
  • loss of data
  • service interruptions
  • third-party failures
  • configuration errors
  • false positives/negatives

Even if we have been advised of the possibility of such damages.

Your use of PerkyDash is at your own risk.

14. Modifications to Terms

We may modify these Terms at any time. Updates will be posted on this page with a revised "Last Updated" date. Continued use of the Service constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the European Union and Italy, unless otherwise required by mandatory local law.
